Waiver

I hereby release and forever discharge each of the organizers, its officers, employees, volunteers, agents, contractors, public bodies, landholders and sponsors, from any and all claims, suits, demands, expenses, costs, actions and proceedings of any nature whatsoever, which I, my executors or administrators or any other person has or might assert against any of them arising from, in relation to, incidental to or by virtue of any injury, loss or damage suffered or sustained by me in connection with my participation in the Event or at any time when I am near the Event. This includes but is not limited to Huw Kingston Pty Ltd t/as Wild Horizons, Forests NSW, National Parks & Wildlife Service, NSW Police, NSW Maritime, Snowy River Shire Council, Cooma Monaro Shire Council, Bega Valley Shire Council, Eurobodalla Shire Council, Snowy Hydro, Thredbo Village, Perisher, Lake Crackenback Resort, and Buckenderra Resort.

I hereby indemnify and hold harmless, and shall keep indemnified and held harmless, each of the organizer, its officers, agents, contractors and sponsors from and against all claims, suits, demands, expenses, costs, actions and proceedings of any nature whatsoever arising from, in relation to or by virtue of:
(a) Any injury, loss or damage sustained by me
(b) Any injury, loss or damage suffered by any other person as a result of any act, omission, neglect or default on my part, in connection with my participation in the Event or at any time I am near the Event.

This waiver should be construed as a risk warning and is given as a risk warning in accordance with the provision of the Civil Liability Amendment (Personal Responsibility) Act 2002. Mountain biking is a dangerous recreational activity that involves a significant risk of physical harm.

I hereby agree that in the event of cancellation of the DT Swiss Mountains to Beach Event by the organizers for any reason whatsoever and I am unable to attend a rescheduled Event, if held, then 50% of my entry fee will be refunded. If the event is not able to be rescheduled I understand that my entry fee will not be refunded.

I hereby agree to allow my photograph, video, multimedia or film likeness to be used for any legitimate purpose by the organizers, sponsors or others.

I hereby agree that I am responsible for my personal accident and ambulance cover. I understand that I must wear an approved cycle helmet at all times I am riding the bike, and that Australian road rules apply at all times on classified roads, unclassified roads, and forest roads.

I have read this form and agree to abide by all Event rules and the directions of all Event officials.
