Waiver

I hereby release and forever discharge each of the organizers, its officers, employees, participants, volunteers, servants, agents, contractors, public bodies, landholders and sponsors, from any and all claims, suits, demands, expenses, costs, actions and proceedings of any nature whatsoever, which I, my executors or administrators or any other person has or might assert against any of them arising from, in relation to, incidental to or by virtue of any injury, loss or damage suffered or sustained by me in connection with my participation in the events of the Highland Fling (which includes but is not limited to The Highland Fling, Casual Fling, Rolloff World Championships and Bundanoon Dash, collectively known as the Event) or at any time when I am near the Event. This includes but is not limited to Huw Kingston Pty Ltd t/as Wild Horizons, Forests NSW, National Parks & Wildlife Service, NSW Waterways, Roads and Maritime Services, Wingecarribee Shire Council, Goulburn Mulwaree Council.

I hereby indemnify and hold harmless, and shall keep indemnified and held harmless, each of the organizer, its officers, employees, participants, volunteers, servants, agents, contractors, public bodies, landholders and sponsors from and against all claims, suits, demands, expenses, costs, actions and proceedings of any nature whatsoever arising from, in relation to or by virtue of:
(a) Any injury, loss or damage sustained by me
(b) Any injury, loss or damage suffered by any other person as a result of any act, omission, neglect or default on my part, in connection with my participation in the Event or at any time I am near the Event.

This waiver should be construed as a risk warning and is given as a risk warning in accordance with the provision of the Civil Liability Act 2002 (NSW). Mountain biking is a dangerous recreational activity that involves a significant risk of physical harm.

I understand and acknowledge that there are risks, hazards and dangers associated with the Event which cannot be eliminated or reduced, including, but not limited to, the risk of bodily injury and harm.

I hereby agree that in the event of cancellation of the Event by the organisers for any reason whatsoever and I am unable to attend a rescheduled Event, if held, then 50% of my entry fee will be refunded. If the Event is not able to be rescheduled I understand that my entry fee will not be refunded.

I hereby agree that in the event of cancellation my entry fee for the Event will not be refunded.

I hereby agree to allow my photograph, video, multimedia or film likeness to be used for any legitimate purpose by the organisers, sponsors or others.

I hereby agree that I am responsible for my personal accident and ambulance cover. I understand that I must wear an approved cycle helmet at all times I am riding the bike, and that Australian road rules apply at all times on classified roads, unclassified roads, and forest roads.

I have read this form and agree to abide by all Event rules and the directions of all Event officials.
